Special Considerations for Landlords in Portland, Maine

Portland is unique within New England in that it is one of the few cities with strict rent control and housing laws. Among the requirements:

  • Complex rent control policy with limitations on rent increases and banked rent (applies to both long-term and short-term rentals)
  • Rental application and credit/background check fees for tenants are prohibited
  • Annual landlord rental registration for both long-term and short-term rentals
  • Periodic inspections by the city
  • Different requirements for smoke and CO2 detector requirements than the rest of Maine
  • Special rights for tenants during occupancy and when ending a tenancy
  • Special rules for snow removal, parking, and falling ice
  • Depending on the size of the property landlords may be responsible for providing trash service and trash bins
  • If police visit a home 3 or more times in a 30-day period it is classified as a disorderly house. If this happens twice in 3-year period, the City may condemn the property and sue the owner for damages
 
Fines for Non-Compliance:
  • Failing to register a long-term rental  is $50 (per-unit) with additional $150 fee (per-unit) after 45 days
  • Failing to register a short-term rental is a minimum fee of $100 per day per unit increasing to $2500 per day over time with an additional $1,000 fee if any of the information provided in the registration is false.
  • Failing to clear snow/ice from the sidewalk outside of a residential (1-4 unit) property within 18 hours of the storm is $75 for the first occurrence ($125 2nd, and $250 3rd) plus 110% of the cost to have the City do the work.
  • Failing to clear snow/ice from the sidewalk outside of a 5+ unit property within 12 hours of the storm is $250 for the first occurrence ($500 2nd, and $1000 3rd) plus 110% of the cost to have the City do the work.
  • Significant Code Violations (ex: blocked ingress or egress, excess occupancy in unit, unsanitary conditions, inadequate or defective plumbing or electrical system, inadequate or defective smoke/CO2 detector system
    • $200 – $2500 per violation per day
    • Failure to correct within required period: $500 – $5000 per violation per day
    • Second notice to correct an additional: $1500 – $10000 per violation per day
